After hearing her friend's account, Lubatti and another woman, Nicole Biancofiore, "walked up to the first cop we saw and told them what happened."

The more I read and hear, the more I'm convinced that Ben is a creepy douche asshole as a human being, but I've not read nor heard anything that makes me think he's committed any wrong other than being a creepy douche asshole. Also, you'd think a girl would be saying,"No!!! Stop!!! Get off of me!!! Get the fuck away from me!!!!" if a guy is about to rape her. But the police report says that she stated that she told him,"No, this is not OK." If some big galoot is about to "rape" you...you'd think you'd use a little stronger language/words than "No, this is not OK." I realize she was drunk but still.

First off, the evidence coming out now is just being released. It had been collected awhile ago but during the investigation that evidence is kept private. Also, there are many cases of wrongdoing that are not pursued. Some factors are lack of physical evidence. Its hard to prove guilt when its a he/she said type of case, doesn't mean that the events didn't take place though. Also, some victims do not want to go through the situation all over again during the trial especially when dealing with a high profile defendant. -
