I think the NCAA is using interesting math techniques. They say he got paid for 20 hours that he never worked, and was getting paid for other hours that he supposedly never worked. James argued that drive time to the Independence area from Columbus and back was included in Posey's compensation.
James said in a letter dated Sept. 30 to Doug Archie, OSU's associate athletic director for compliance, that the days and hours Posey worked were incorrectly reported. Independence Excavating originally reported that Posey worked 10 hours the week ending March 27, 2009, 24 hours the week ending June 18, 2009, 20 hours the week ending Feb. 19, 2010 and 16 hours the week ending March 25, 2011.
According to the letter, the hours should have been reported as 10 hours, 11 hours, nine hours and 16 hours, respectively, and Posey was paid for those hours. Each week incorporated driving time to Independence from Columbus and back as part of his compensation, which is normal for union employees.
Posey was paid a grand total $978.49 from DiGeronimo, which accounts for 65.23 hours of the 70 hours for which he was paid, assuming he was paid $15 per hour.

OSU and NCAA enforcement staffs concluded that Posey was paid for 70 hours of work, despite only working 21.5 hours. He was overpaid by 48.5 hours and $727.50.
There was a Dispatch article (I think) where Gee said that Posey was not treated unfairly by the NCAA and OSU had worked with the NCAA in this investigation. -
WriterbuckeyeI'm not defending Posey here...but I don't believe or trust OSU to be unbiased in this. They want this over and the NCAA done with them. If they prolong this by appealing, it does neither.
In any event, Posey probably shouldn't be on the team, anymore, given his blatant disregard of the rules. If we had a real head coach, I think that would have happened. Fickell either doesn't want to make those kinds of decisions or he isn't allowed to. I'm not sure which -- but he's done enough stuff poorly to warrant being let go at the end of the season. So I guess it doesn't matter. -
HitsRusGee's comment...which differs considerably from Gene Smith's, illustrates my contention that all entities in an investigation need their own representation. The interests of OSU and Posey are not necessarily one and the same.

Apparently OSU decided not to forward the additional documentation because to do so would have delayed the decision into November anyway.
It is just more evidence of the mess that the NCAA and its "compliance rules" have become.
All of this for a sum total of maybe $2000 over 2 years at the most,,,supposedly rational adults have ruined a kid's career.
Former coach Earle Bruce was incredulous over the additional 5 game suspension for such a paltry sum..."Teach the kid a lesson, but don't ruin him."...and that was before the documentation came to light. Of course, Bruce coached in a day when the NCAA actually took the student athlete's interests to heart.

Posey may be ineligible to play but he's still a student at the OSU.
How is this ruining a career? Michael Vick (and I can't stand him) and Plaxico Burress served jail time and still had a career.
If the guy can play at the next level, he'll get drafted. I'm not certain of that.
I'm playing the world's smallest violin for this guy, and his mother. If he truly came to OSU to get his degree he can still get it.
This program is an embarrassment. -

He lost an entire year of development for pocket change. Show me something that proves he is a bad kid. Show me anything that justifies this.

He's not occupying Wall Street? What the fuck does that to do with anything? Also, I'm pretty sure he is able to practice so your "lost a year of development" theory doesn't apply either. -

The only thing he is guilty of was selling stuff for tattoos, and for that he was severely punished given the suspensions levied on other players.The latest accusations are certainly cast in doubt....so that eliminates the multiple "offender" arguement. At most he might be guilty of not realizing that someone was paying him too much pocket change for working.

Manhattan BuckeyeI don't if Posey's a bad guy or not, but he screwed up twice, yet still has access to his education, the athletic dept., the weight room, the trainers, etc. If he's NFL bound he is, many players have done more with less and impressed in the combine/interview.
He appears to acquaint himself with the wrong people, whether it is with the tattoo parlor or with Cesar Geronimo or whatever his name is. That isn't a good history. -
HitsRusLook, I don't want to go back and reiterate the points I've made thoughout this thread, but it'not all about Posey and Ohio State although it creates a forum for discussion. The NCAA as a governing body has become bloated and out of control, the enforcement of its 'rules' is selective and heavy handed. It holds its member institutions hostage with the funnelling of hundreds of millions of dollars (while restricting the laborers from earning from the fruits of that labor). The Ohio State University and other member Institutions are dependent of that money to run its athletic programs, and such, are forced to cow-tow to the NCAA lest they be struck with even more severe penalties. Devier Posey is an example of how one can get ground up in the gears of the system for minor infractions.

That's shady stuff for a communications major who is working for an excavating company of a guy who is having $100 hand shakes with players.
