I talked to my lawyer today on another matter. I broached this subject with him and he said freedom of the press is a tough nut to crack. You must prove the false accusations were done with malice, to win the lawsuit. But many are settled out of court for some loose change. Also if a dad asked his son if he's hanging out at a tattoo parlor smoking pot while he's supposed to be going to class and practicing, its really easy to deny the tattoo affiliation.

Like I said, there will be a failure to state a claim since the article was not written with the malice necessary to constitute an intentional tort or infringe on constitutional rights -

Are you assuming said players will qualify as "public figures?" Even so, malice also = reckless disregard for the truth. Unfortunately, crack journalism today allows a writer to author a national piece with less than credible sources. It would be a difficult case to win. -
jordo212000The article was a little light on information. That part was disappointing. If you are going to point the figure at college athletes, you should at least be fair and point out specifically what they did. He kind of just mentioned them and then glossed over specifics. Not really fair to the kids. Because like I have mentioned before "innocent until proven guilty" doesn't generally exist in the court of public opinion.
I will say this though. If Klein is completely innocent, good for him. I hope he brings this writer down a couple of notches. If he is guilty of "something," he is opening up a pretty big can of worms. He better hope that this writer doesn't call his bluff. (I have heard that the writer says he has plenty of more evidence up his sleeve...not sure that I believe that though) -

I agree with you that if Klein fights this, he better be damn sure he has no skeletons we wants uncovered....and this is just writer speak for "I sure hope you don't call me out on this" -
