    While you wouldn't be able to seek damages or even win a court case, it really sound like constructive eviction by the other roomate.

    Shes in law school, she said she would love to take me to court.

    She already had a letter to send me, I wouldn't give her my address cuz I didn't wanna deal with it, just rather pay her and move on. Take a dump on her porch, etc.

    Tell her that you feel it was a case of constructive eviction due to the conditions changing drastically. Say you have pictures and video of the conditions, blah blah blah. See what she does.

    Not to mention pay my attorney. All over $365 which yeah it sucks to pay but its whatever ill be getting paid fairly well soon anyways.

    yea they always say that....and the letter really means nothing that is her trying to scare you...a letter doesnt even mean anything. i bet shes too lazy to sue you

    I stupidly didn't take pictures or videos but I did have 6 different people see the place while I was there for the 6 days and they all said how disgusting it was and would be a witness in court if needed.

    u wont need an attorney either. just go to court and say you wanted to live there and you got there and it was dirty and offer to pay for the six days. i bet you would win.

    Don't pay her anything. Wait until she actually files suit(she won't). Then pay her. Chances are, she doesn't want to spend that kind of money just to be an ahole to you, because if she sues you its going to cost her time and money.

    If you go to small claims court, tell them you'll agree to pay for 6 days because of how disgusting the situation was.

    Before I call her back...am I off the hook for the rent money? I mean I didn't sign anything...but I did live there for 6 days without paying anything. Do I have to give her money for the 6 days I lived there?
    Pay her for the 6 days and move on. Don't be a cheap bastard. If you stayed their for 6 days, why would you think you don't owe her 6 days worth of rent?!

    Interesting situation. As LJ mentioned, laws on things like this vary drastically from state-to-state and from city-to-city. If her place actually was unlivable, and you reasonably relied on her assurances that it was livable, and you can demonstrate both of those, you potentially could have a case. The problem is that even if you have a case, it can cost more to win than it does to lose (e.g., do you want to pay an atty a few hundred bucks an hour to represent you? Do you want to pay court costs? Do you want to deal with the hassle? Do you want to run the risk of having a judgment against you?).

    She can (and probably will) file in small claims court if you don't pay her the full amount. You'll be at the mercy of the Cook Cty court system at that point.

    The problem with dealing with lawyers is that they're all certain they're going to win, and they assume that if they can't win, they can at least bully you into doing what they want. In many instances, it's best to wash your hands of it and move on without fighting over it. Consider it an expensive lesson learned and move on.
