Help w/ a lease/sublease situation

  • SportsAndLady
So I just recently moved to Chicago. Found a place to sublease at until June 31. I moved in last Saturday (3/10) and picked up the sublease papers from the landlord. I had to get the lady I was subleasing for, and the roommate's signature on this paper as well as mine. I emailed her to come sign this and she said she will be out of town until 3/16. So I just sat on the papers until she got back.

In the 6 days of living there, I thought I was going to be sick at how disgusting this chick was that I was living with. There was food left out for what looked like to be more than a week, moldy drinks sitting around, kitchen had no counter space because it had nasty dishes out, there were cockroaches in the bathroom, and the place smelled like a rotten animal or a dead rotten human being (either one works).

So, yeah, I moved out and am now living at a friend's apartment's extra room for less money a month.

She just left me a voicemail saying "call me asap, I heard you moved out..when are you going to pay me my money"

Before I call her back...am I off the hook for the rent money? I mean I didn't sign anything...but I did live there for 6 days without paying anything. Do I have to give her money for the 6 days I lived there?

Wow that really sucks lol. If you didn't sign anything, not sure how she can force you to pay.

You owe her for 6 days.

Yeah I just want to check with the OC contract law/attorney people to make sure I do the right thing from here. I feel pretty confident there's no way she can make me pay becuase I didn't sign anything (and I tried getting her to sign it, but she was just like i'm gonna be out of town for 10 days..I was like umm alright?...so I made an active attempt to get her to finalize this thing, but she didn't do it).

But I just wanna make sure I don't do anything stupid here

I kind of thought that would be the case, do you have any idea to this or do you just want me to suffer?

If you didn't sign anything and didn't give her a verbal agreement I would pay for the 6 days you stayed there and be done with it.

I feel like technically you don't have to pay her, because she didn't sign anything, and you guys were never locked into a contract, but maybe out of courtesy you pay her the 6 days. If the bitch is that crazy to leave her place in such a shitty condition, she is crazy enough to try to take it to court. Paying her the 6 days will most likely satisfy her.

Or you can just fuck her in the ass.

You didn't sign anything. Just avoid her calls. Unless of course you get a certified letter, then I'd pay for the six days.

Are 31 days in June a Chicago thing?
  • DeyDurkie5
You should also fart in her face when she is sleeping

You need to get ahold of a lawyer in your area and figure out the specific laws. They can vary greatly from area to area.

Call one of the colleges and say you are enrolling next quarter/semester. They usually have a student tenant legal assistance
  • Speedofsand
She probably has a redneck friend that will tow your car unless you pay her.

I'm going to email her back now. Just be like look I'm really sorry but I could not live there it was unlivable, and I found a place for less rent. Since we couldn't get the papers signed when I was moving in, I feel like I was not obligated to stay and sign.

If she then says she wants her money, I'll call someone.
  • Speedofsand
DUMBASS! Do not tell her you found a cheaper place!

Don't tell her any of that

"Hey, I found another place because your place was unlivable. It smelled like someone died, it had moldy dishes everywhere, and quiet frankly it should've been reported. I am sorry but those were not the type of living situations I expected coming in. So yes, I did move out."
  • Automatik
I would just tell her the place was a hell hole and you couldn't live there. Since nothing was signed, unless I'm mistaken you can get off without paying anything.

I say upper deck her and do her sister.
  • hoops23
    Just give her the $50
  • Little Danny
    LJ is spot-on.

    Then do her sister.
