    As much as I think it is a douche move on whoever turned him in, there is one thing to keep in mind. The first amendment gives people the freedom of speech, which means the government can not stop you from saying stupid crap.

    However, the 1st Amendment does NOT give you freedom from consequences of saying stupid crap.

    I can't walk into my boss's office and cuss him out and then say "freedom of speech b!tches, you can't fire me!".

    Same thing online, if you do stupid stuff on FB or where ever there is chance it could have some real life consequences.

    You're the lawyer, but my layman's understanding is that the 1st amendment isn't a blanket "get out of jail free card" for what one says. As you indicated, I tend to try to stay away from topics that either start or evolve into full retard status, so I have no idea what was said in most of the threads that the other poster provided links for. Assuming the worst, and that cc posted blatantly racist remarks, is possible action by his school board a legitimate reaction on their part? Disclaimer: My guess is most if not all of his "objectionable" posts were nothing but trolling.

    Despite how you feel about CC, his online persona is not who he is in real life. For one, no one is that idiotic (ha). I can tell you first hand that it's no fun when a message board and real life intersect, so I feel bad for him. I'm sure anxiety is kicking his ass right now.

    Correct. There must be some sort of state (gov't) action in response to (or anticipation of) your speech.

    Not to nitpick, but I'd add the word "illegal" or "inappropriate" to your sentence. If jmog goes to work in the public sector, telling his boss to gfh is no more protected than if he does so today at his private sector employer.

    If he was typing things that one might find offensive during his school hours, then he could get in trouble. Once he is ratted out, his superiors will probably read every single one of his posts, regardless of the time he made them.

    Which probably should be assumed unless proven otherwise. If someone went to the trouble of collecting a bunch of his posts and posting them together with the "I'm taking this to your district, the newspaper, etc." threat AND was serious about that BUT didn't have a back-up in the event CC or the site took everything down, well, they'd be about as intelligent as CC's persona on this site was.

    Fucked up situation. I disliked CC's on-site persona a lot and generally try to avoid any race-related topic as much as possible (there's always a weak moment or two where I click on one and get sucked in for a bit before I realize I'm starting to hate myself) because of his and a few others' personas here. But I'm more along the lines of making his life hell on this site for being how he is. Taking it and turning into real life stuff that could potentially be harmful to his personal and professional life is a good ways beyond that.
