That's not your call. What this ban says is that you cannot have a private enterprise that caters to the smoking public.
What this ban says is that no one can open/operate a restaraunt for people who want to smoke while they dine.(Even if it is clearly posted to that end.) -

Technically you can if you can generate 80% of your revenue from tobacco sales (which means you have to give away your food).
