    I knew that would be the response. I think anyone who is open and serves the public should be treated like a public place. Otherwise, make it a private establishment.

    A private establishment? Meaning a members only club? Or how about a public establishment that has certain procedures that keep some of the public away?
    You have the right to go to an establishment I own, but that doesn't mean I have to make sure you enjoy your stay. If you don't like it, don't come back. Free market.

    I don't need or want protection. If I want to go to a restaurant and eat with smoke in the air, I should be allowed to be that dumb.

    totally agree, that's why I directed it at smokers. I had an aunt die from lung cancer and her sister was so upset that she smoked all the way to the cemetary in the same car with my uncle. My uncle was really pissed off and it almost caused a huge scene at the burial.

    This is true that a lot of bars don't enforce this law, so the smokers can go to those bars. Nobody is forcing them to go to the ones that enforce it.
