I would say Batman does have extraordinary powers, or in the alternative he is quite skillful or successful.
It's been generally accepted for a while that plenty of "superheros" are without actual powers like superman, but do a lot with their intelligence/assets/fighting ability to fight crime.
The disagreement only comes from a strict interpretation that the majority has clearly declined to adopt. I think the fact that the genre itself adopts a character such as Batman as a superhero is good enough for everyone else. -

Anyone finding batman's belt and becoming a superhero? Surely you jest. Batman is an incredibly intelligent guy with extraordinary fighting powers as well. A whole other planet full of people had superman's abilities... they were all just killed. When the genre itself accepts them as superheros, it's kind of hard to argue with you know... people who create it.
