Why can illegals sue Americans in court?

Why can illegal immigrants use OUR court system to sue Americans. Seems a bit ridiculous. If you can't legally be in our country you shouldn't have access to our legal systems. Give the guy a medal for actually defending our border, something our Federal government won't do.Federal appellate judges have refused to overturn the civil verdict against a Cochise County rancher found guilty of illegally imprisoning 16 border crossers.

NAW...The illegals will get favorable press, free food, free health care, and free tuition all at the rancher's expense.iclfan2;669448 wrote:Why can illegal immigrants use OUR court system to sue Americans. CenterBHSFanIf the Obama administration is going to sue one of the states from The United States of America simply for upholding a law, then illegal immigrants can certainly sue Americans in court.
It's just what our country has degenerated itself to, including our own damned government. -
fish82Dude shoulda just shot the lot of them and buried 'em in a field. End of problem.

Yes...that would have been a good idea..then he would have gone to prison. Smart idea fish
The reason he was sued if because he illegally imprisoned 16 human beings. While them crossing the border is wrong,he can't imprison them just because he wants to -

It is illegal to imprison people in the United States. Not just US citizens. You cannot break the law just because the people you are abusing aren't citizens.iclfan2;669448 wrote:Why can illegal immigrants use OUR court system to sue Americans. Seems a bit ridiculous. WriterbuckeyeI'd argue he can make a citizen's arrest and detain them until authorities arrive -- and it's not imprisoning them.
In any event, part of the reason we have such a horrible problem with illegals, benefits and debt is because of judges who basically give away the store. -
I Wear PantsI think there are very specific things that have to happen for one to be able to make a citizens arrest. Also, we don't know how long or how he imprisoned them.
-
iclfan2My problem with it is they literally can't be in America legally. It isn't someone with a Visa, someone here on vacation, etc, they were IN THE PROCESS of breaking the law. Not to mention, if you aren't legally allowed in the country, you shouldn't be able to spend AMERICAN's dollars on a judge and court room.

I Wear PantsI saw a kid walk across my yard today, technically I could call that trespassing. Therefore I have the right to imprison him right? Nope.
That they weren't US citizens is irrelevant to the fact the Rancher broke the law by imprisoning people. -
iclfan2That is your opinion, and those two courts opinion, I disagree.
-
I Wear PantsDid the Rancher break the law? Yes or no?

First this word imprison. Did he lock them up for an extended period of time? Or did he detain them until the authorities arrived and determined what to do with them? One is imprisonment. The other is not.I Wear Pants;670880 wrote:I saw a kid walk across my yard today, technically I could call that trespassing. Therefore I have the right to imprison him right? Nope.

Second this kid walking across your lawn. Did he appear dangerous? Do you live in an area where criminal activity is occurring at a higher level? Is your lawn in an area that dangerous drug smugglers use to bring drugs into this country? Your analogy does not compare to those on the southern border.
By the way if kids are on your lawn this is how you should handle it.

Precicely. He held them at gunpoint until the authorities arrived. These yahoos are acting like he kept them locked in his fucking basement for a month or something.Writerbuckeye;670670 wrote:I'd argue he can make a citizen's arrest and detain them until authorities arrive -- and it's not imprisoning them.

I never saw where it said how long he had them detained. -

He detained them on the spot where he found them. Called his wife who contacted border control and they took them into custody. Calling that imprisonment is a bastardization of the English language.I Wear Pants;671002 wrote:I never saw where it said how long he had them detained.
The immigrants are represented at trial by the Mexican American Legal Defense and Educational Fund (MALDEF), which also charged that Sheriff Dever did nothing to prevent Mr. Barnett from holding their clients at “gunpoint, yelling obscenities at them and kicking one of the women.”
In the lawsuit, MALDEF said Mr. Barnett approached the group as the immigrants moved through his property, and that he was carrying a pistol and threatening them in English and Spanish. At one point, it said, Mr. Barnett’s dog barked at several of the women and he yelled at them in Spanish, “My dog is hungry and he’s hungry for buttocks.”
The lawsuit said he then called his wife and two Border Patrol agents arrived at the site. It also said Mr. Barnett acknowledged that he had turned over 12,000 illegal immigrants to the Border Patrol since 1998.

They're criminals, and trespassing on his property. He's perfectly within his rights to detain them until the authorities arrive.Ty Webb;670621 wrote:Yes...that would have been a good idea..then he would have gone to prison. Smart idea fish

Little DannyThis lawsuit has "Stella Award" written all over. I will be looking forward to reading how this guys got millions from this rancher and his insurer.
-
stlouiedipalmaI think Mr. Barnett deserves a heartfelt apology from our government and a citation/medal of some sort.
-
Al BundyHe sounds like a true hero. He has helped capture 12,000 criminals over that last 13 years.

Sounds like what he did was pretty reasonable to me. This country has some F'd up priorities.Roger Barnett, 64, began rounding up illegal immigrants in 1998....Mr. Barnett told The Washington Times in a 2002 interview that he began rounding up illegal immigrants after they started to vandalize his property, northeast of Douglas along Arizona Highway 80. He said the immigrants tore up water pumps, killed calves, destroyed fences and gates, stole trucks and broke into his home. “This is my land. I´m the victim here,” Mr. Barnett said. “When someone´s home and loved ones are in jeopardy and the government seemingly can´t do anything about it, I feel justified in taking matters into my own hands. And I always watch my back.” -
stlouiedipalmaI sure wouldn't want to mess with this man. He sounds like he means business.

majorsparkSome of his cattle died from ingesting the plastic bottles left behind by the immigrants, he said, adding that he installed a faucet on an 8,000-gallon water tank so the immigrants would stop damaging the tank to get water.
Mr. Barnett said some of the ranch´s established immigrant trails were littered with trash 10 inches deep, including human waste, used toilet paper, soiled diapers, cigarette packs, clothes, backpacks, empty 1-gallon water bottles, chewing-gum wrappers and aluminum foil - which supposedly is used to pack the drugs the immigrant smugglers give their “clients” to keep them running.
Environmentalists should be outraged.
