Guy steals a car with a couple's 3 children inside.  Father catches up when traffic holds the thief up.  Thief assaults the dad, then ends-up getting beaten to death by an angry mob.

Not clear if the dad was involved or participated, but let's assume he is:

1) Let's not debate charges - would you want to see that father in jail or not, and if so for how long?

2)  What about the mob?  You know who was fighting, but you don't know which punch/kick proved fatal nor do you know who did it.  Are they all guilty of murder?  How much jail time should they get?

I wouldn't charge anyone. Fuck that guy, don't steal people's shit.

agreed......street justice sometimes seems like justice.  But we dont live in Iran or North Korea for a reason.  The crime does not fit the punishment of death.  We live in a civil society that requires restraint and laws.  

You just cant beat people to death for stealing........  I would like to see a lesser charge and no fines or jail time.

I was on a grand jury in Boston for 3 months at the beginning of the year. Guarantee there will be surveillance of the incident and there will be multiple ABDW and/or AB causing serious bodily injury, if not murder charges. Everyone they can identify will be charged. We had similar group crimes to consider, though not with the kidnapping component. Either way, it's not up to the mob to provide justice.

Basically what I was thinking.  If they popped him a few times, no harm no foul.  But it went way beyond detaining the guy for police [obviously], and you're right at minimum AB with serious bodily injury which should be good for a few months in the can.  I don't really want to see the video, but my suspicion is it was probably like 2-3 people doing most of the beating, so others might get just a simple non-felony assault charge.

The father you might give some leeway to depending on the video.  But if he and his family were out of harm's way, and then he went to join in with the mob, then he's as guilty as any of the mob.
