As far as her admission goes, read two lines later:
"In that statement, she claimed that Roethlisberger followed her into a bathroom and had sex with her without her consent."

Innocent until proven guilty only applies in a court of law. The reality of what happened is something altogether different. The DA was very emphatic that if he could prove it, he would move forward. He just didn't have enough evidence to prove it. It seemed very evident that he felt Roethlisberger did assault the girl.Prescott wrote:

Again, we are talking about interpretation, not legal proof. You believe he is innocent - although you cannot provide evidence to prove it. I believe he is guilty - although I cannot provide evidence to prove it. If I had to hear this case as a juror, I would listen to the facts and apply them to the law. If you read enough police reports, you tend to get a sense of what the officer really believes happened, whether or not the evidence is CONCLUSIVE enough to go to trial.
Conflicting comments by rape victims are not uncommon, especially when drugs or alcohol were involved.
That's why in these kinds of cases, DAs usually want some pretty rock solid evidence (including DNA) before they'll pursue a case. Otherwise it becomes he said, she said and those usually stalemate with jurors.
I happen to believe the girl was sexually assaulted and there just isn't enough evidence to prove it beyond a reasonable doubt.
Unless he gets himself sober (I believe Ben is an alcoholic), something like this (or worse) will happen again. I've seen it too many times. -
