Gonzaga students facing expulsion for self-defense

    Yes, they broke the rule, but at some point common sense has to prevail in dealing with situations like these.

    I don't fault the students one bit. Like you said, they broke the rules, but I'd rather break the rules and be alive to face the consequences than the potential alternatives. It's a shame that there are those who would rather see these kids dead than have the ability to defend themselves.

    I agree with justin. Why do they think it's wrong to defend yourself against people who aren't students? I doubt they get more than probation with the university now that the nationwide media is in on it.

    The response will be: "They should have checked who it was and when they saw it was a suspicious man called Campus Security so Campus Security could call real cops.

    Think the case of a felon on Gonzaga's campus is an isolated incident? Think again. In 2007, a young woman named Amanda Collins was raped at gunpoint just 50-feet from the campus police station at The University of Nevada-Reno. The University of Nevada-Reno is a gun free zone. At the time of the attack, Collins was in possession of her concealed weapons permit but was not in possession of her firearm due to university policies prohibiting carrying concealed weapons on campus. Her attacker, a serial rapist, went on to rape two more young women, killing one of them. Red-tape and university policies empowered her attacker while she, the victim, was punished.


    "I was legislated into being a victim," Collins said in an interview with NRA News.

    Since the school owns the property, they can evict (there is no 2nd Amendment protection for tenants), but I'm curious why they were removed from school.

    A landlord cannot ban guns from a private apartment. While the school owns these apartments, they are not on school grounds. Heller v. D.C. says "the 2nd Amendment protects an individual right to possess a firearm unconnected with service in a militia, and to use that arm for traditionally lawful purposes, such as self-defense within the home." This apartment was "home" to these students. So, there is a gray area here, I believe they have a case to fight this.

    We now know why the multi felon was on campus. Generally those types of dorms have security system doors ... how did he get in? Where was the security or was it not working. Liberal justice system doesn’t work and the liberal minded college administration system doesn’t work but the standard method of CCW self-protection does.

    A landlord would likely win. There are certain things landlords can't do, based on statutory law (i.e. discriminate against people of "X") but when it comes to private contracting they have quite a bit of latitude.

    It is still pretty stupid for them to include this in the lease agreement, and for the most part is unenforceable.

    Clearly you didn't read the article. Not a dorm, no security doors, no security guards, it's not even on campus. I'm sure it's the liberal justice system fault why this guy was released six times, because i doubt this repeat offender was a criminal during any republican presidencies. Any more drivel to add?

    My understanding is that if the University is the owner of a building that house students the law requires a security system, on campus or off campus. The party of the president or community organize has little or nothing to do with the lower court judicial system.

    As crazy as this sounds, if my landlord provided in the lease agreement that I wasn't allowed to post on OhioChatter, which would obviously be a violation of the First Amendment if a government entity , it would probably be legal.

    This. As long as its not a state school. The constitution only protects people from the govt, not other private entities.
