Landlord/Tennant question ...

O-TrapMy wife and I are under a lease with a man from the area. Quite frankly, I don't have much patience for the man, but he's typically a nuisance at worst.
I just got an Email from him stating that he did not receive the rent check for the month of December. To ensure that he isn't given a bad check, he requires payment via a cashier's check. Our bank records prove that we indeed had one made out.
Will the bank be able to verify for us that he indeed received and/or deposited it? If, somehow, it got lost in the mail, is there a way to prevent it from being cashed by a third-party finder? If there is no record of him receiving it, are we liable, even though we already paid for one already? -
Cleveland BuckEdit: Never mind. I didn't read that you paid him with a cashier's check. I assume they have a way to see if it has been deposited, but I have no idea if you can stop payment on a cashier's check. I know you can stop certified checks, but cashier's check are supposedly treated like cash, which means you might not be able to stop it. You would have to call the bank and ask them.

ThumperACdo you still have the "receipt" part of the cashier's check from the bank, if not, the bank will have it on file. And yes the bank and tell you if the check has cleared (been cashed/deposited). Yes, I believe that you can put a stop payment on the check if you believe it to be lost.

icskinsThe bank can track it for you. They can also stop payment on it like a regular check, I believe. I am not sure how much the fee would be. If someone else did indeed get it, they would have to provide proof of ID in order to cash it. If he really did not receive the check, you are liable. It is not his fault either and he probably has a mortgage to pay with the money he receives from the rent. If this is a one time deal, I would hope that he would work with you on it.

O-TrapAssuredly, I understand that it isn't any fault of mine. We have record of it being made out. A couple relatives of mine are bankers, so I'm going to ask them tomorrow, to see if they can verify that the check has been processed.
Do money orders work in the same way? I believe he gave us the option of a money order as well. What is the difference between the two? -

When it comes to rent payment in Ohio, it's your responsibility until it reaches the hand of the landlord. Now the only exception to that rule is the post mark, but that is just for late/not late purposes.O-Trap wrote: Assuredly, I understand that it isn't any fault of mine. -
Cleveland BuckI know you can't stop payment on a money order. Other than that I really couldn't explain the difference between the two other than to say that a money order is not attached to a checking account, it is attached to the money your paid for the money order, from what I understand.

darbypitcher22Pretty sure you can put a stop payment on it; in fact I would encourage you to do so until you figure out exactly what happened... he can't just throw you out on your ass.... hope it all gets figured out
