The laws don't allow you to protect yourself with any means necessary. For deadly force there has to be an objective and subjective threat of death or serious bodily injury. However, there are state laws that do modify it for situations like in your home (castle doctrines as you mentioned) but those vary drastically from state to state. For example in Florida I believe you can just pretty much shoot any intruder, even if he is on his way out.LJ;1115850 wrote:Because of stand your ground and castle doctrines, it's harder and harder for an instigator to prove self defense. Because these laws allow you to protect yourself in any means ness., someone who instigates a situation isn't going to get the benefit of the doubt.
Every mod with the ability should Neg Mcburg as you are either racist or an idiot.mcburg93;1116122 wrote:The kid ran making the guy with the gun jumpy in his mind the kid is doing something wrong, obviously the kid did nothing wrong now that we know the story. But at the time the guy prolly full of adrenaline and excited cause he has some authority thinks the kid did something wrong. Gives chase wrestles with the kid then shoots him. The kid did nothing wrong he just provoked this guy. The guy should be guilty of murder in some sort.
I'm sorry, but if I'm a 17 year old kid and I'm minding my own business walking home in the dark, and some adult starts coming after me or following me I would most likely start walking faster and eventually run, and if I get caught, I'm sure as hell going to fight.
There is nothing to justify what this man did. From the OP's article and CNN article, I think some real investigation is necessary (the one Witnesses comment about the boy calling for help but police officer correcting her saying it was Zimmerman). And I really doubt self-defense holds up. And if it does, it's a damn shame. The police believe a person can pretty much just shoot a black kid in a white neighboorhood and call it self defense? If that holds up, I'm ashamed to be an American. -

Im not disagreeing with any of this. I completely agree with you. All Im saying had the boy not run or even talked to the guy from a distance none of this wouldve happened and the kid would be alive. Its a tragic thing that happened I would prolly be just like the kid dead. Cause I wouldve run and fought back. Hindsight being 20/20 Had the kid not run he would prolly still be here.Fly4Fun;1116160 wrote:The laws don't allow you to protect yourself with any means necessary. A lot of southern states have Stand your Ground laws that apply to public places. Basically makes your "castle" your personal space everywhere you go.Fly4Fun;1116160 wrote:The laws don't allow you to protect yourself with any means necessary. Florida's version
person who is not engaged in an unlawful activity and who is attacked in any other place where he or she has a right to be has no duty to retreat and has the right to stand his or her ground and meet force with force, including deadly force if he or she reasonably believes it is necessary to do so to prevent death or great bodily harm to himself or herself or another or to prevent the commission of a forcible felony. -

Hindsight being 20/20 had the guy just stayed in his car like he was told the kid would still be here. You keep going back to the kid running as the reason he is dead. That is not the reason he is dead. He is dead because some jackass overstepped his authority and shot him for no fucking reason.mcburg93;1116166 wrote:Im not disagreeing with any of this. Ya, I know southern states tend to be a bit more "forgiving" with self defense. That's just how it is. But my point is that you can't just use deadly force whenever. Even in the Florida statute you quoted there is a standard: "reasonably believe it is necessary to do so to prevent death or great bodily harm to himself...".LJ;1116167 wrote:A lot of southern states have Stand your Ground laws that apply to public places. I'm surprised it seems to be a totally subjective standard, I wonder if the courts do try to also use an objective standard as well.
My point: it's not any force necessary, but generally there is a standard. But it's hard to generalize when talking about criminal law as it does vary greatly from state to state typically in regards to regions of the countries. -

The kid did nothing wrong. I agree with everything thats been said about the guy. He needs prosecuted to the full extent of the law. He shouldve never got out of his car. He shouldve never pursued the kid. He definitely shouldn't of had a gun. -
Gblockim not even sure the kid ran...no way that fat **** should have been able to catch him right?

This. The "kid shouldn't have run" argument might have made sense if it was an actual cop AND if the kid was walking with a loaded gun or a toddler's head or something like that. But this? An overzealous jack-off taking neighborhood watches to an insane level? ZERO percent of the blame should be on the teen.justincredible;1116170 wrote:Hindsight being 20/20 had the guy just stayed in his car like he was told the kid would still be here. If he is innocent, he has no duty to do anything but reasonably protect himself. He did this by running. It was the right thing to do.mcburg93;1116175 wrote:The kid did nothing wrong.
Also, what makes you think that if he didn't run he wouldn't have gotten shot? This guy was quoted as saying "these assholes always get away" before he even confronted the kid. He obviously thought the kid was guilty before he started running so he might have shot him anyways. You saying "if he didn't run, he wouldn't be dead" is not just stupid, it's plain wrong. -

I cant say he wouldnt be dead. Like I said it couldve turned out differently who knows. I have an opinion about a guy that has power issues cause hes part of neighborhood watch. A kid that ran and prolly shouldve ran. He just didnt run fast enough.Mooney44Cards;1116185 wrote:If he is innocent, he has no duty to do anything but reasonably protect himself.
