6 Year Old Trying to Hook up with Teacher?

    PHILADELPHIA - A judge has overturned a 6-year-old's expulsion from a Philadelphia charter school for touching his teacher's thighs after she complained that her legs hurt.

    The 6-year-old, who had three earlier suspensions, was merely trying to comfort his teacher, the judge concluded.

    "I want to make them feel better," the boy told his teacher, according to a May 23 ruling by Common Pleas Judge Paul P. Panepinto, first reported on by The Legal Intelligencer.

    The case, involving the First Philadelphia Charter School for Literacy, hints at a larger question that looms as the number of charter schools explodes across the country.

    The Philadelphia-based Education Law Center argued that charter schools — federally-funded but privately run schools — sometimes seek more leeway in disciplining students using the argument they can always return to a traditional public school.

    "This 'double-standard' view is legally flawed," staff attorney Paul Lapp wrote in a brief filed on behalf of the boy's family. "Charter schools are public schools and are on exactly the same legal footing with respect to the disciplinary sanctions of suspension and expulsion as are 'regular' public schools."

    First Philadelphia officials argue that the law gives them broad discretion to discipline students, especially after a series of disciplinary problems.

    The boy had been suspended for 10 days in December for touching a girl's bottom while under a table picking up crayons. He was then suspended twice for stepping on his classmates' shoelaces or otherwise tripping or shoving them, according to the school's brief. And he caused regular disruptions, to the point that another teacher labeled him an "8'' on a scale of 1 to 10 for disruptiveness, the brief said.

    Panepinto focused solely on the March 19, 2010, touching incident with the teacher in finding the school had abused its discretion.

    "In permanently expelling a 6-year-old kindergarten student that had only been in school for seven months, (the school) made a gross abuse of discretion that was not supported by evidence in the record," the judge wrote. He said we would expunge the boy's record of his expulsion.

    The teacher testified at an April 2010 school disciplinary hearing that the boy's contact made her feel uncomfortable, while acknowledging that other students regularly give her hugs, the judge found.

    "There's not anything that made it seem one bit inappropriate," Lapp told The Associated Press on Monday. "This is developmentally normal behaviour."

    In court papers, he said there was nothing sexual about the encounter. Questioned by his mother about the incident, the boy said he wished he were a doctor so he could help people, according to the family's brief.

    The school cast the encounter as far more ominous.

    "It is inappropriate for a 6-year-old child to touch an adult teacher on both upper thighs, near her crotch area, while the adult is sitting, in a school setting. This is especially so where such child has a protracted and admitted history of inappropriate touching/ behaviour," the school argued in its brief.

    The case has been moved to mandatory mediation by the courts, and will proceed to the state's Commonwealth Court if no resolution is reached, said lawyer David Annecharico, who represents the charter school. He otherwise declined comment.

    The law centre believes the Commonwealth Court will be asked to set a statewide precedent on whether a child so young can be expelled for such behaviour.

    The boy has transferred to a private school and has had no significant behavioural problems since, Lapp said.

    Hard to pass judgement on something like this without being close to the situation. Innocent touching versus lewd or sexual contact is a slippery slope issue with kids this young. I do believe that the school should have worked with the parents in meeting with them and trying to look into his recent past, there might be something deeper like molestation of the child that would lead to him doing this. As for the charter school side of it, thank you judge, you get it! lol

    Wow, expulsion seems a bit harsh! I also agree with what redstreak states. Something is probably going on at home for such behavior!

    Funny thing is I actually did something similar when I was in kindergarten(back in '81). Wow, have times have changed? In my situation the teacher was lining us up to come in from recess and we had to line up in alphabetical order. My last name starting with A, I was first in line. When she grabs my hand to walk us into the school, I took her hand and kissed it! Instead of filing a complaint she just looks down to me and says, "Awww, I love you too!"

    Did you ever know a kindergarten teacher that couldn't stop/prevent themselves from being sexually assaulted by a toddler?

    Uh, the lady is an adult teacher. The kid is a 6 year old kindergartner. If she can't keep a 6 year old from touching her thigh, I don't want her teaching my kids. Clearly she's a dumbass.

    I'm sure she didn't just sit there and let the kid rub her pussy. Come on. The kid sounds like trouble. Expulsion may have been extreme, but some action needed taken.

    Would like to know more about the charter school itself. This sounds like a classic case of them trying to get rid of a student (or whose parents) don't "fit the profile". It's like getting on the wrong side of a small-twon police department.
