Can car insurance be claimed if the accident takes place on my property?

    I need to know what happens when someone damages my car on my property? We live in OH and a guest who had come over for dinner pressed the gas instead of the brakes and hit my car. Can I claim from his insurance company? He says since this is on my property, I cannot claim from his insurance. Is that right? Please help!

    His insurance is responsible.....I had a friend hit the gas instead of brakes(LOL), go through my garage door, hit wifes mini van and pushed into my 5 year old gas grill......my insurance co said its on him....HIS insurance come out, pays to fix my garage door, my back of minivan, front of minivan AND gave me the cash for a NEW gas grill.....

    HE caused the accident, NOT you!!!!

    His fault. He gave you a bunch of bull, and who gives a shit? File the claim, let his insurance and your insurance duke it out.

    Also, what a shitty friend or guest or whatever. He needs to rectify the situation if he doesn't want a claim on his insurance. What did he say? I'm curious. Was it like "Sorry, I hit your car. It's too bad its not my problem since it was on your property." What a joke.

    In Ohio, the owner of the vehicle and the driver of the vehicle (if they are different) are pro-rata responsible for the damages caused to other's property on an actual cash value basis.

    Since it is on your property, most local authorities will not respond to the call to file a report. But that is not needed for insurance purposes.

    Is your guest an insurance adjuster or a lawyer? What makes him an expert? I hate when people act like they know what they are talking about when they are completely wrong. I think the guest had his facts confused. He was probably thinking about if you owned two autos, and one struck the other. In that scenario, if you had collision coverage on both you would have two deductibles as your liability coverage would not cover damage to an auto that is on the policy. Pursue the claim against the guest, he is completely wrong.

    Some carriers would waive both deductibles in that type of incident.

    Is he offering to just pay you instead? Somebody hit me and I just got an estimate and had them write me a check for it so their insurance wouldnt go up. then I took care of it myself (actually made some money by finding a cheaper place). If he isnt offering to do that and is trying to lie to you, then you have a real douche bag of a so called friend.

    Thank all..I’ll be calling him and taking insurance details. @sleeper, he said something like “oops..I feel like such an idiot; but don’t worry that’s what your insurance is for”; @littledanny, he’s a school teacher (of all the noble professions!!!); @the4ringz, he’s not really a friend, he’s my sister’s friend, I met him for the first (and hopefully last) time; @sumofanump, I’ll specifically ask my insurance about the deductible, but do I need to pay one if I’m claiming from his car insurance?; @pick6. No. he made no such offer and that’s why I am so mad at him!

    Deductibles are only for the damage to your auto if you caused the accident.

    Deductibles do not apply for damage to others autos that you damage.

    Yeah, sounds like he wanted you to claim it on YOUR insurance (and then up to them whether they go after him and his insurance, which they most likely would but he was probably hoping not). You didn't cause the accident and shouldn't have to file. Contact his insurance directly. If he gives you shit, call your company and let them deal with it.

    My girlfriend just so happens to be a licensed insurance agent...

    This claim is valid. you can contact their insurance agency for the repairs. She told me if they give you hassle, contact your own insurance agent and they will fill out a form that will force the other company to pay for your damages. That dude is at fault 100%. Get your car fixed bro, hope this helps.
