  Ummm, Yeah. If you are going to take it upon yourself to play cop when you are in fact not a cop, you better be a little more careful not to kill the ACCUSED in the process or else you should have to suffer some consequences.
  
  This guy sounds like he may have some personal frustrations, if witnesses were able to hear the victim say he couldn't breathe and the guy kept squeezing his neck. Maybe this fellow shouldn't have been shoplifting if that's what he was doing, but as far as I know death is not the punishment for that crime.

  Look I don't care about the end result, what I am saying like Scarlet said if you don't break the rules you don't allow for something like this to happen. He breaks the law, sure the CVS employee was in the wrong probably for even touching the guy but he did it and it ended badly. However if the guy doesn't steal nothing ends badly. When you commit a crime, no matter how small it is, bad things can transpire!!

  there are very few reasons where i would consider it "okay" to kill someone. this is definitely not one of them.

  Knowing what I know about choke holds with experience in jiu jitsu...
  
  You can make someone pass out inside of 10 seconds if done right as a "blood choke" (4 seconds depending on the pressure and location of the pressure). Also, if the person applying it doesn't let go as soon as he feels his opponent go limp, brain damage and death can occur.
  
  However, if the victim in this case was screaming "I can't breathe", it probably wasn't a blood choke, so it wasn't as "lethal" as a blood choke (meaning as easy to kill accidentally). With the pressure/location of a blood choke, you aren't talking/screaming anything.
  
  Edit: Also, if it took "several minutes" it was an air choke, not a blood choke.

  If you can talk, you can breathe!!! As a high school wrestling official know how many times I hear that from kids on their backs getting pinned, I do not stop the action if the kid tells me he can't breathe!

  I just don't buy into this being an accident. If you can hold on to someone and choke them to death, then you should be able to hold them down without hurting them. If you want to knock them out, punch the guy or something--not that that can't kill someone too but I just don't buy it. You don't choke someone to death by accident unless you do something like jmog described on accident because you don't really know what you're doing. But that doesn't sound like it was the case either.

  What I "imagine" happened is this.
  
  The "choke" started off as just an arm around the neck squeezing tight, then whent he shoplifter said "I can't breathe" the guy squeezed harder and possibly reapplied the choke to get the guy to pass out until the cops got there.
  
  At that point the location of the choke might have switched to a "blood choke" and the applier had no idea what he was doing and the shoplifter might have been dead within 30 seconds after that.

  There might not be charges pressed by police, but that employee (and CVS) are going to get their asses handed to them in civil court.

  Its not even like this guy owned the joint, its a corporate CVS store. Believe me, they'll recoup the losses from a tube of toothpaste worth less than a dollar and a pack of crayons worth probably less than a quarter. Unfortunately, this poor guy who died won't have the chance to turn his life around. And I'm sure the manager feels awesome that he took a man's life over some pocket change.
  
  Where did the mentality come from that if you commit any crime that you're asking for it and you deserve to die? So if I go 30 in a 25, I deserve to be murdered by someone who calls the police on me? Believe me, speeding is about the equivalent of petty shoplifting.

  I didn't read anyone saying he was asking for it, some said including I don't feel sorry for him. What was said is if you break the rules/laws bad things can happen no matter how petty the act may be. This was down right petty but he chose to steal and bad things ended up happening. If he pays for those items he is still breathing air I imagine. Again not saying he deserved this one bit, I just don't feel sorry for him as I bet he was asked to stop and he took off running and this guy gave chase (right or wrong he decided to try to get away with crime).

  I didn't think that you were allowed to chase suspects out of your store. At the very least it's probably against store policy (I know it is at Walmart).
  
  Also, would it make a difference if the alley wasn't on the store's property?
