SC Justice Antonin Scalia has died

    Presidio County Judge Cinderela Guevara told Fox News that she determined Scalia had died of natural causes. Guevara also said that she had spoken to local investigators and U.S. marshals, as well as Scalia's family and personal physician, before determining that an autopsy was not necessary.

    Let get this straight: Police shot and kills a teen there is an autopsy. Women killed in local traffic accident there is an autopsy. Woman drowns in car crash there is an autopsy. Hunter fall from tree deer stand there is an autopsy. President shot there is an autopsy. Man found dead at the mall in his car there is an autopsy. Senator shot there is an autopsy. Police dog killed there is an autopsy. Crib death there is an autopsy

    But a SC Justice is not…. get this fat guy in the ground ASAP...

    Hopefully you realize the difference between a fat, old guy actually exceeding the average life expectancy dying vs the examples you provided which include people dying in accidents or murdered.

    but i can give you other examples like athletes death, crib deaths ,,

    would dying in a hotel room be an accident... or standard daily life style.

    Was the person 80 years old and fat?

    You're bringing up extreme deaths and comparing them to what happens to thousands of men every day. I agree it's at least worth an autopsy but let's not justify it by comparing it to the baby who died in its crib or teenager while playing football.

    I don't think that means what your or the blogger does....it's about recess appointments, meaning when Congress is out-of-session confirmation is circumvented. This was used not that long ago with respect to the NLRA, I believe.

    If Obama puts up a moderate, I don't see how Repubs can't confirm. The grandstanding will be a moot point if Hillary is elected, and if a Repub does win they will get to replace possibly 2-3 judges, restoring or changing the balance again. And if they lose control of the Senate, a moderate is the best you can hope for even with a Repub POTUS.

    IMO, the ideal balance is 2-5-2 or possibly 3-3-3 (which is closer to what it was with Scalia). It's popular to say the court was 5-4 conservative, and no doubt that's the story being pushed to pressure Repubs to confirm a liberal, but Kennedy and Thomas vote with liberals enough to be considered moderate or non-partisan.

    That has to do with recess appointments, which I agree, both R's and D President do too much. (W with John Bolton and Obama with some Judges).
    But, that says nothing about during an election year. The law was referring to the recess period when Congress is out of session, which I actually agree with that law.

    Still, if you are referring to the Thurman rule, John Oliver had a nice clip last night from 2008 where McConnell said the rule does not exist. Now, he wouldn't back out on his word would he for political gain? Surely not.....

    Life goes on....cases that the court has agreed to take on will be argued. If for some reason there is a 4-4 tie then the appellate ruling stands.
