Federal judge declares entire Obamacare law void

    26 states get a favorable ruling in challenging the Obamacare law. Judge says, "because the individual mandate is unconstitutional and not severable, the entire Act must be declared void."

    Not unexpected and will go the Supreme Court.

    I'm pretty sure the score is 2-2 with 2 judges ruling for and 2 judges ruling against the law suits. My hope is that the Supreme Court upholds today's ruling in Florida.

    If they don't, then the SCOTUS has a problem. It should be a slam-dunk decision.

    Now, hopefully, a real Health Care Reform proposal will be drafted instead of one that is full of entitlements and payola......one that takes a few good ideas from this bill (insurance for pre-existing conditions, etc) and couples that with tort reform and other non-solialistic provisions that will really benefit all of the citizens of the United States.

    Don't forget the ability of businesses and individuals to purchase health insurance across state lines.

    Sorry, but no session of Congress has bothered to tackle this until the most recent one. My prediction is that the SCOTUS will strike it down and any kind of true health care reform will be dead for the next 30 years. There's simply too much money involved for conservative members of Congress to bother fooling with it. It wasn't important to them before, why should it be so now?

    Personally I don't see how Justice Scalia is going to escape his reasoning in regards to the scope of the commerce clause in Gonzales v. Raich from which upholding the Affordable Care and Patient Protection Act would seem to follow IMO. If that's true, I think you'll see a 6-3 opinion supporting Obamacare.

    They actually are considered persons. They have rights just like you and me.

    If they uphold this mandate on health care, they are setting up the ability of the government to control everything we do with commerce. Doing nothing should be an option that cannot be touched.
    The only way the bill gets upheld as is will be if the Supreme Court rejects the decision at the top of this thread because they don't agree that one part of it makes the entire piece of legislation void. That's really the only thing that even has a chance of hanging this up.

    Just out of curiosity, when did we ever see a conservative demand real and meaningful health care for the people of this nation prior to being presented with an actual bill that provided it under "Obamacare"? There was not even a whimper from the conservatives until now. It leads me to believe that the conservatives were perfectly happy before all of this "Obamacare" rattled their cages enough to start their bellowing about big government interference, socialism, communism, and all the other fear mongering terms they are so good at. They had no plan because they were not the ones living without health care. They still aren't. They were (are) the ones who voted to subsidize huge corporations who mismanaged their way to oblivion, only to award their disgraced executives huge golden parachute escape clauses from any responsibility for their
    horrendous mismanagement and subsequent rewards. These are the same people that claim that Obama's health care plan is socialism. Wow , when you think about it, it boggles the mind. I'm thinking that the conservatives are hoping and praying that the SCOTUS goes along with them and kills health care once again. I don't think the Supreme Court will find for them. If they don't, be prepared to hear how the liberal media caused the vote to turn out the way it did." Always excuses, never a real plan". By God, I think I've just created a slogan that accurately describes the conservative health care plan if they are elected in 2012.
